Welcome to votepamavery.com (the "Site"), the official website of the Pam Avery Campaign for Brevard County Commissioner, District 1 (the "Campaign," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms of Use ("Terms"). If you do not agree, please do not use the Site.
Eligibility
You must be at least 18 years old to submit forms, make contributions, or sign up to volunteer. By using the Site you represent that you meet this requirement.
Campaign Contributions
All contributions are processed by our payment processor (Anedot) and are subject to Florida campaign finance law, including:
- Contributions must be made from your own funds, not those of another person.
- Contributions from corporations, labor unions, foreign nationals, and federal government contractors are prohibited where applicable by law.
- You must be a U.S. citizen or lawfully admitted permanent resident.
- Contribution limits set by Florida law apply.
- Contributions are not tax-deductible for federal or state income tax purposes.
- Contributions of $100 or more are reported to the Florida Division of Elections and become part of the public record (including name, address, occupation, and employer).
By contributing, you certify that you meet these requirements. We reserve the right to refuse, refund, or report any contribution that does not comply with applicable law.
Acceptable Use
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms
- Submit false, misleading, or fraudulent information
- Impersonate another person or misrepresent your identity
- Attempt to interfere with, disrupt, or gain unauthorized access to the Site or its systems
- Use automated tools (bots, scrapers) to access the Site without our written permission
- Harass, threaten, or harm any person via Site features (including the contact form)
- Upload viruses, malware, or other malicious code
Intellectual Property
All content on the Site — including text, graphics, logos, images, and the Pam Avery Campaign name and likeness — is owned by or licensed to the Campaign and is protected by U.S. and international copyright and trademark law. You may share Site content on social media in support of the Campaign, but you may not reproduce, modify, distribute, or use Site content for commercial purposes or in opposition to the Campaign without our written permission.
User Submissions
By submitting any content (messages, comments, volunteer information) to the Campaign, you grant us a non-exclusive, royalty-free, perpetual license to use, reproduce, and display that content for Campaign purposes. You represent that you have the right to grant this license and that your submission does not violate any third party's rights.
Communications Consent
By providing your email address or phone number, you consent to receive campaign communications, including fundraising appeals, event invitations, and updates. Message and data rates may apply for SMS. You may opt out at any time by following the unsubscribe instructions in any email or by visiting our unsubscribe page.
Third-Party Links and Services
The Site contains links to third-party websites and services (such as Anedot for contributions and social media platforms). We are not responsible for the content, policies, or practices of these third parties. Your use of those services is subject to their own terms and privacy policies.
Disclaimers
The Site is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure. Statements about Campaign positions reflect the candidate's views at the time of posting and may evolve.
Limitation of Liability
To the fullest extent permitted by law, the Campaign, its committee, staff, volunteers, and vendors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, even if advised of the possibility of such damages.
Indemnification
You agree to indemnify and hold harmless the Campaign from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site.
Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any dispute arising from these Terms or the Site will be resolved in the state or federal courts located in Brevard County, Florida.
Changes to These Terms
We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. The "Last updated" date at the top reflects the most recent version.
